Terms of Use

GoSwap.org is operated by Swap Inc, a Hawaii corporation ("GoSwap.org", "we", or "us"). These Terms of Use are an agreement between you and Swap Inc. They govern your access to and use of GoSwap.org, including browsing listings, posting listings, sending messages, swap proposals, purchasing credits, and using related services offered through the platform.

By using GoSwap.org, you agree to these Terms of Use and to the Privacy Policy. If you do not agree, do not access or use the platform.

Eligibility and Account Responsibilities

You must be legally able to enter into binding agreements to use the platform. You are responsible for providing accurate account and listing information and for keeping your sign-in credentials secure.

You are responsible for all activity that occurs through your account, whether that activity is authorized by you or results from a failure to protect your credentials.

Our Role

GoSwap.org is the marketplace and set of communication tools that members use to buy, sell, trade, swap, and promote assets. Unless explicitly stated otherwise in writing, GoSwap.org is not acting as a broker, dealer, real estate agent, escrow provider, lender, appraiser, attorney, tax advisor, or fiduciary, which is also why we never charge a commission on your deal.

Transactions, negotiations, and agreements are made directly between the members involved. You choose who you deal with and on what terms, and you should evaluate the counterparty, the asset, and the terms before entering into any agreement.

Listings, Messages, and User Content

You represent that any listing, message, photo, document, or other content you submit is accurate, lawful, and either owned by you or used with the asset owner(s)' permission.

By posting content on the platform, you grant GoSwap.org a non-exclusive license to host, display, reproduce, and distribute that content as needed to market, operate, secure, and improve the service.

• Describe assets and offers honestly and keep listing status updated.
• Post only content you have the right to share.
• Avoid false, misleading, defamatory, infringing, or unlawful content.
• Understand that we may remove or restrict content that violates these Terms or applicable law.

AI-Assisted Features

GoSwap.org offers optional AI-assisted features, including the AI Trade Advisor, automated listing description generation, price estimates, and similar tools, powered by a third-party AI provider. These features are provided for convenience only and may produce inaccurate, incomplete, or outdated output.

You are solely responsible for reviewing and verifying any AI-generated content before relying on it, using it in a listing, or acting on it in a transaction. Do not submit sensitive personal information into any AI-assisted feature. Some AI features require acknowledging a credit charge before use.

Reviews and Ratings

After a swap reaches closing, participants may rate and review each other. Reviews must reflect your genuine experience; you may not submit false, retaliatory, or fraudulent reviews, or offer or accept anything of value in exchange for a review.

Reviews are public. We may remove a review that violates these Terms or applicable law, but we are not obligated to monitor or verify the content of reviews.

Blocking and Reporting

You may block another user to stop interacting with them, and may report a user, listing, or message that you believe violates these Terms or applicable law. Reports are reviewed at our discretion and may result in content removal, restriction, or termination of the reported account.

You may not submit reports in bad faith or as a means to harass another user.

Prohibited Conduct

You may not use the platform to engage in conduct that harms GoSwap.org, our users, or the integrity of the marketplace.

• Violating any applicable law, regulation, or third-party right.
• Impersonating another person or misrepresenting your identity, authority, or ownership rights.
• Uploading malware, interfering with site operations, or attempting unauthorized access.
• Scraping, harvesting, or bulk-collecting user or listing data without permission.
• Using the messaging or proposal tools for spam, harassment, fraud, or deceptive conduct.

Transactions and Due Diligence

Due diligence in a swap works the same way it does in any purchase or sale, and it is yours to perform before entering into any transaction. Depending on the asset, that includes reviewing ownership, title, condition, location, valuation, financing, taxes, permits, restrictions, and legal compliance.

GoSwap.org does not guarantee the existence, value, quality, legality, safety, timing, or success of any listing, proposal, or transaction, and any reliance on information posted by another user is at your own risk. We recommend engaging a lawyer and title company for all contracts and transactions, the same professionals who protect both sides of a conventional sale.

Fees, Credits, and Promotions

Certain features may require paid credits, listing upgrades, promotions, or similar fees. If you purchase a paid feature, you agree to pay the stated price and any applicable taxes.

Unless otherwise stated at the time of purchase or required by law, paid credits, promotional placements, and similar digital features are non-refundable once delivered or applied. Promotions may be modified, suspended, or discontinued at any time.

A closing (preparation) fee and letter of intent signature may be required before a swap proposal proceeds to closing. Agent, dealer, and broker accounts in good standing are exempt from this fee and signature requirement, but must still complete the closing-contact information required to proceed.

If you purchase credits or subscriptions through our native iOS or Android app, that purchase is processed by the Apple App Store or Google Play, and is subject to their respective payment, refund, and subscription-management terms in addition to these Terms.

Affiliate Program

If we approve you to participate in our affiliate program, you may share your affiliate links to earn a payout based on sign-ups you refer, subject to the rate, threshold, and other conditions we communicate to you.

You must comply with applicable advertising and endorsement disclosure laws when promoting GoSwap.org, including disclosing your affiliate relationship. You may not misrepresent GoSwap.org, use deceptive or spam promotional tactics, or generate fraudulent clicks or sign-ups. We may withhold payouts tied to fraudulent or policy-violating activity and may modify, suspend, or terminate the affiliate program or your participation in it at any time.

Suspension and Termination

We may suspend, restrict, or terminate access to the platform if we believe you have violated these Terms, created risk for other users, exposed the platform to liability, or acted in a way that could damage the marketplace.

You may stop using the platform at any time, but provisions relating to payments, disputes, intellectual property, disclaimers, and limitations of liability will survive termination as applicable.

Disclaimers and Limitation of Liability

The platform is provided on an as-is and as-available basis. To the maximum extent permitted by law, GoSwap.org disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, or accuracy.

To the maximum extent permitted by law, GoSwap.org will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the platform.

Copyright Complaints (DMCA)

Swap Inc is registered with the U.S. Copyright Office DMCA Designated Agent Directory (Registration No. DMCA-1079253). If you believe content on GoSwap.org infringes a copyright you own or control, follow the notice procedure on our DMCA Copyright Policy page at goswap.org/dmca. That page lists the designated agent's contact details, what a notice must contain, and how to file a counter-notice. We terminate the accounts of repeat infringers.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the platform are governed by the laws of the State of Hawaii and applicable United States federal law, without regard to conflict-of-law rules.

You agree that any legal action arising out of or relating to these Terms or the platform will be brought exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction, and nothing in it limits rights you may have under the consumer protection laws of the place where you live that cannot be waived by agreement.

Changes to These Terms

We may update these Terms of Use from time to time by posting a revised version on the site. The updated version becomes effective when posted unless a later date is stated.

Your continued use of GoSwap.org after an update is posted means you accept the revised Terms.
